General Conditions of Sale

It’s beforehand clarified that the present conditions govern sales, by ALLIANCE MAGIQUE. These conditions apply excluding all other conditions.

SECTION 1 – PRICE
1.1 Our product’s prices are indicated in euros, all taxes inclusive (VAT), except contribution of treatment and shipping costs.
1.2 In case of order towards a country other than France, you are the importer of one or several concerned products. For all the products sent out of European Union and French Overseas Departments and Territories, the prize will be calculated exclusive of tax automatically on the invoice. Customs duties or other local taxes either import duties or State’s taxes may be due. These rights and sums do not recover from the competence of ALLIANCE MAGIQUE. They will be at your expense and raise from your whole responsibility both in terms of statements and payments at competent authorities of your country. We advise you to inquire about these aspects with your local authorities.
1.3 All the orders, whatever their origin, are payable in Euro.
1.4 Alliance-magique.com reserves the right to modify its prices at any time, but products will be charged on the current price rates basis, at the time of the order’s recording, on condition of availability.
1.5 Products remain the property of Alliance-magique.com up to the complete payment of the price.

SECTION 2 – ORDERS
2.1 On Internet : www.alliance-magique.com.
2.2 The contractual information is presented in French language and will be the object of a confirmation resuming these contractual information at the latest at the time of delivery.
2.3 Alliance-magique.com reserves the right to cancel or to refuse any order of a customer with whom there would be a dispute concerning the payment of a previous order.

SECTION 3 – VALIDATION
3.1 You declare to have acquainted and accepted the present General Conditions of Sale before the signing of your order. The validation of your order is thus worth acceptance of these General Conditions of Sale.
3.2 Except contrary proof, the data registered by Alliance-magique.com establish the proof of all the transactions spent by Alliance-magique.com and its customers.

SECTION 4 – AVAILABILITY
4.1 Our products and prices offers are valid as long as they are visible on the website, within the limits of available stocks.
4.2 For products not stored in our warehouses, our offers are valid subject to availability at our suppliers.
4.3 Within this context, indications on the availability of products are supplied to you at the time of the signing of your order. This information resulting directly from our suppliers, some errors or modifications can exceptionally exist. In the eventuality of an unavailability of product after signing of your order we shall inform you about it by e-mail as soon as possible. Your order will automatically be cancelled and you will be paid off immediately if your bank account has been debited.
4.4 For the payment by check, in case of unavailability of all or any of the order, the repayment will be made in the choice of ALLIANCE MAGIQUE by credit on the bank account of the customer or by check at the latest in thirty days as from the payment of the sums paid by the customer.

SECTION 5 – DELIVERY
5.1 Products are delivered to the delivery address which you have indicated during the order process. The indicated delays are usual average delays and correspond to the delays of treatment and delivery.
5.2 In case of available articles at different dates considering their availability, the delivery within is based on the longest delay. Alliance-magique.com reserves however the possibility of splitting the deliveries. The contribution to costs of treatment and shipping will be charged only once. Alliance-magique.com cannot be held in charge of the consequences due to a delay of routing. Any command not sent in 30 days following the order is cancelled unless otherwise stipulated and announced in the sale offer.
5.3 In case of delay, an e-mail will be sent to you.
5.4 In case of payment by credit card, the indicated term are average delays and correspond to the treatment and delivery for products bound for metropolitan France and Monaco.
5.5 In case of payment by check, the order will be treated at reception of the check. Consequently, the applicable term in that case are the ones in the day of opening of the check and can be thus modified with regard to those mentioned in the day by the signing of the order.

SECTION 6 – PAYMENT
The payment of your purchases is made:

The debit of the card is made only at the time of the shipping of your order.

6.2 By Check: In case of payment by check, this one must be emitted by a bank resident of metropolitan France or Monaco. The presentation of the check for payment is realized at the reception of the check. SECTION 7 – REASSURANCE
7.1 Our site is the subject of a system of reassurance: we adopted the SSL’s process of encoding proposed by Mercanet (BNP).

SECTION 8 - SATISFIED OR PAY OFF
8.1 You have a delay of 7 days at your disposal from the reception to return the product which would not be convenient for you. The return expenses will be then at your charge. Only the price of one or several bought products will be paid off.
8.2 The returns are to make to ALLIANCE MAGIQUE - 13 AVENUE GEORGES POMPIDOU-31130 BALMA - FRANCE in their original packing, complete (accessories, notice) in good condition, accompanied with a copy of the invoice.
8.3 Products returned incomplete, damaged or dirty by the customer are not picked up.

SECTION 9 - PRODUCTS’ CONFORMITY
9.1 We commit ourself to pay you off or to exchange you the defective products or not corresponding to your order. In that case we thank you for explaining with great detail in writing and to send back to us one or several products. Alliance-magique.com will proceed, at your choice, to the exchange or in the repayment of one or several products. The demand must be made in seven working days following the delivery. Any complaint formulated outside this term cannot be accepted. The sending expenses will be paid off to you on the basis of the charged price rate and the expenses of return will be paid off to you. In any case, you benefit of the clause of the legal guarantee, notably to those relative to the latent defects guarantee.
9.2 The clauses of this article don’t prevent you from benefiting from the retraction right, foreseen in “Section 8”.

SECTION 10 – REPAYMENT
10.1 The products repayments in the hypotheses aimed at sections 8 and 9 will be made by a delay lower or equal to 15 days after the reception of products by our services.
10.2 The repayment will be made in the choice of Alliance-magique.com by credit on your bank account or by check sent in the name of the customer having placed the order and at the address of invoicing. No sending in cash on delivery will be accepted, whatever is the motive.

14.1 The present contract is subjected to the French law.
14.2 The language of the present contract is the French one.
14.3 In case of dispute, the French courts will be only competent.
